I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. My wife recently got her H4 extension approved. She got her I-797 approval form. While going for H4 stamping, Is she required to carry my original H1B I-797 also?

The US Chamber of Commerce is seeking a review by the nation's highest court of the Arizona law that calls for the revocation of business licenses for employers found to have knowingly hired illegally present immigrants and also mandates all employers in the state use E-Verify. I'm creating a car game. i managed to get the car moving and all, but i dunno how to make the car collide with the obstacles when it hits it.
How do i make it such away that if the car overlaps the kind of obstacle i want, dont have to be simple shapes but mostly oddly shaped obstacles, it would stop. that'll be good.

Due to a sudden demise of my wife's grandmother, my wife had to go to India last week. She is planning to come back by Nov. 15. I received the receipt notices for my wife's I-485, I-131 and I-765. My question is if the fingerprinting notice comes before she arrives and also if it is scheduled prior to her arrival date on Nov. 14; what are the options of rescheduling and can we get the date of our choice after Nov. 14. Also, I would be extremely grateful, if someone could upload a sample fingerprinting notice from USCIS. I couldn't find any where on the site.

As of May 29, 2009, approximately 45,800 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

Hi everyone:
Can someone suggest if I'm in a hot water over this issue. My company applied for the labor certification back in Dec. 2002. In the Labor Certification form they quoted 40 for the "Total hours per week". The LC was approved back in July of 2007. Later in Sept. of 2007 we filed I-140 and I-485 concurrently.
In April of this year my company received an RFE for the I-140, where USCIS requested some additional translations and my W-2 forms for all the years of my employment. We've responded to it.
So here's my question. Since 2002 my working schedule changed and now I work 32 hours per week, that is different than 40, which was included in the LC. It doesn't say anywhere in my W-2's, but one can easily see that I'm being paid less by doing some simple math.
Do you think this would pose a problem and if so, what shall I do at this point?

Please help me with this. i came to USA on L1B visa in 2005 with 1 year petition and got extension for 2 more years i.e till feb 2008 but went to india for good in June 2007.
Again we came back with new L1B petition in Oct 2007 and got 3 years visa i.e, till Oct 2010.
1) Now if company apply for extension on L1B how many years ext i'll get?
2) Now if Company B wants to file new H1B for me, how many years of visa i'll get.
i was never on H1 before this is my first time H1B.
Please help me with this as soon as possible.
