I94 date doesnt matter for entry on AP as parolee status.
Just continue on H1 or EAD whichever you have been using and keep extending AP too for travel.

jaytubati - I have teh same situation, I already got my EAD card and I-130 approved documents. But today I got duplicate receipts for both I-765 and I-130 with rfe for photograpgh

Please take couple of secs to finish this poll. No matter what was your case for interview..extension, renewal, first time..when was H1/H4 etc approved..where it was approved..etc etc..nothing matters. All that needs to be tracked is wait time.
As long as New Delhi consulate please do this and this will give an idea for wait times.

I am currently on H1B and in the process of leaving my current employer XYZ Inc. I also have an EAD that I haven't used yet but plan to use going forward. I understand that XYZ will and is rather obligated to notify USCIS of termination of my H1B employment by virtue of which, USICS will take steps to revoke the H1B petition. That being said,
1. Will I (beneficiary) and / or XYZ (petitioner) will receive a notice saying my H1B petition has been revoked?
2. Will it help in any shape or form if I were to fill an (back dated) I-9 form with XYZ indicating that I was already on EAD with XYZ before my termination? In this case, is XYZ still obligated to notify USCIS of termination of my H1B employment?
3. What constitutes a "bona fide termination" and is this even applicable in my case? Should I have a formal resignation letter in place for audit / RFE purposes down the road, if any?

Hello everyone ! 13 years ago i was charge with Lanercy-theft wich it was a 2nd deg misdemeanor and possesion of cannabis under 20 grams 1st deg misdemeanor i plead guilty and served 3 days in county jail (Florida) , now i'm 32 married to an American citizen and getting ready to adjust my status , i just want to know how hard it"s going to be this whole process , i dont want to be dinied or deported , thanks for any answers.

I and my wife are on h1. I want to come on her h4. She recently applied for h1 extension as her employer is nonprofit org and has some policies of his own, he files every year. She filled in may�09 and got receipt number, as the case is still pending who we can apply for h4 now. Is there any way around to apply for my h4 while the case is still pending?
You can file your H-4 based on the H-1b receipt of your spouse, this is not a problem. They will approve your H-4 for the same duration as your spouses H-1, you will get an approval of H-4 only after your spouses H-1 is approved.

Hi All,
Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.
On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?

All,
IV needs money for rally.
Lets pledge to contrbute right after you get recpits.
We all are skilled immigrations with high billing rates per hour.
Think about how many hours you have spent tracking receipts,
Lets not waste any more time in tracking, instead contribute a few hours to work and contribute some of that money worth to IV.
Lets change one fruitless habbit to fruitful one.
Please contribute.

your lawyer. In many cases, the "most recent action by USCIS" counts. So your H1B gets approved and then H4 gets approved, the last action may count. That is why it is important that you consult a good attorney.

One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.
Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

My friend has his I-485 filed and has got EAD/AP, but the priority date is so behind, that he has no chance of getting a green card before his marriage. So, as I understand he should be able to bring his wife on H4 (as long as he maintains H1). My question is: does he have to re-file for I-485 to include his wife and if so will the priority date remain the same as the first application?

No...I don't think it will be problem. Please don't think too much and worry yourself. Fill in last few addresses and send the forms.
