This Unique Id is good for everyone, T.N.Seshan was recommending this way back in 1988. but the Present Ruling party at that time never agreed because they cannot do hacking polling booths but now it is all very easy.. Guess what.... the EVM electronic voting machines! get rid of that first go back to ballot papers, see who wins and who looses and how people of India are enlightened about the politics. Do they really ahve the guts to do that??

Hi,
My wife has a stamped H4 visa & I-94 both are valid through Oct 16th 2008. We have applied H1B for her which got approved somewhere in May 2007.
The Approved H1B documents along with new I-94 is with her employer.
We have some issues with the employer so we are not sure that we can get the H1B & I-94 documents from her employer.
As we also applied for EAD,In the mean time if we receive her EAD card and Travel Document for my wife.
Do we still need her H1B and new I-94 documents from her employer for any reason?
Any advise is well appreciated.

The Los Angeles City Council has approved a measure barring city workers for traveling to Arizona on official business and also banning the city from contracting with Arizona businesses. Some contracts for key infrastructure items are not affected, but the LA Times estimates that the vote will cost Arizona upwards of $8 million per year. Hi,
Apologize for starting new thread, but this is an urgent request and need attention.
I need to respond to a RFE related to proving Programmer Analyst being a Speciaity occupation.
I researched and found a memo from Terrance Way, Director INS issued a memo on this on December 22, 2000 and is available on AILA Infonet
AILA InfoNet at Doc. No. 01040603
I couldnt locate this memo in USCIS policy guidance memoranda search.
Can some one with access to AILA Infonet, please send me this document

Hello,
I am currently working for employer A on a 6th year H1 with approved 140 petition. MY current H1 is expiring June 2010. In the meantime I got an good offer from employer B who applied for H1 transfer using my approved 140 petition and I got an RFE. My question is god forbid , that if my H1 transfer petition is denied with employer B , can I continue working for Current employer A and if he can file for my H1 extension, come June? Also would there be any recursions, considering i already applied the H1 transfer now with the new employer ?
Please advice and i thank you in advance

I guess these are the cases of cross-chargeability where the principal applicant is born in India whereas the spouce is born in a non-retrogressed country like UAE. Here is the forum which explains on cross chargeability:

If you have a valid I-94 i.e. not expired, you can apply for another I-539 to F1 - make sure to make the application stronger than last time.
If your I-94 is applied, you have no choice but to leave the country and get F1 visa in your home country and come back.

Hello,
I run an IT business from here in Canada and make about US$ 80K/Year. I am now thinking to move to USA and was wondering how I could use my company to benefit and help me with that.
Is it better to move the company to US or is it better to open a subsidiary in USA? Also what are the minimum requirements to be successful in the immigration visa? Do I need to declare a minimum amount to the Canadian government etc.., that will be a proof for my company etc..?
I run the company myself with my common-law-partner. We do everything, including sending bills, invoices etc..

I came to US on L1(worked for 1 year) and then switched to F1 till getting my H1B on May 2005 (which is 2 years old). How many years(3 or 4) do I have left on H1? I mean will the 1 year L1 count towards the total six years allocated for H1B?

Currently, I am working with software firm (not a contract work). My wife is re applying for H4 visa. she applied for h4 last year in Feb, i used to work with contracting firm then and refused under 214b(immigration intent). This time we are applying through attorney. Attorney have sent email thrice to Islamabad consulatein Pakistan stating that denial under 214(b) for H4 is not valid reason.
But no response from them.
However my wife is applying again and taking letter with her from attorney stating that reason was invliad.
I am wondering
1- Do we need to highlight the previous denial so much as she is applying on new h1B now
2- in any case, can they revoke and cancel my petition as if they do not find any valid reason to reject again.
I am looking forward to hear from you

Do note that AILF does cover people who were eligible to file in July but did not file due to USCIS/DOS revised bulletin.....However, it is unknown at this time what the outcome of the lawsuit would be for July applicants vs eligible but non-applicants as the decision is at the discretion of the Judge.....
