    Small or medium companies who played by the rules are doing okay. I transferred H1B couple of times between small companies during 2009-10 recession time and in each case it was approved in 2-3 days. Both the companies had a 100% record in H1-transfer and PERM approval.

    I believe that small companies have a big impact too. As someone mentioned, check to see which companies filed GCs in the last 10 years....Infy, TCS or Small body shops?

    Jumbo loans are not getting approved for EAD status. Banks are rejecting Jumbo loans (> 417K) if your immigration status is EAD or AOS. I don't have any idea about normal loans (< 417K). But banks are giving Jumbo loans if the status is H-1B.

    But noone is rejecting loan, if your down payment is 20% of the value of the home.

    That is exactly what I thought as well. Which is why I'm confused by posters ranting about "people who voted against SKIL bill" and getting their knickers in a twist

    Correct me if I am wrong, ---but I thought that "This Ammendment" was attached to a defence bill. I dont think that it was the ammendment that was shot down, but the whole defence bill.

    This particular Cornyn amendment (S.Amdt. 2339) offered to attach to H.R. 2669 (College Cost Reduction Act of 2007 ), but the motion was failed due to lack of 5 votes.(55 YEAS and 40 NAYs. Require 3/5 majority) HR.2669 is passed by both Senate and house and sent for conference to resolve the difference between house and senate versions and president is sure to sign the bill and thus would become the law in another few days. This amendment does not have anything to do with defence bill or with SKILL bill. Following is the actions taken by congress of HR 2669.

    IF THE AMENDMENT HAD PASSED WE WOULD HAVE GOT ATLEAST 240,000 RECAPTURED, UNUSED VISAS OF PREVIOUS YEARS IN ANOTHER FEW DAYS.

    AFAIK, this memo only applies to those I-140 petitions which do NOT require a labor certification approval. It does NOT apply to EB-2 Advanced degree holder petitions which require a certified labor and BS + 5 yrs or MS + 0 yrs of experience.

    Though, for now, most of us who are filing in EB-2 Advanced degree holder category have nothing to worry, this definitely looks like a targeted approach where they are coming after everybody, one category at a time. So its just a matter of time it seems when they come up with something which targets everyone...

    As per Matthew Oh's blog, this will be adopted on Sep 3rd.

    Hey guys,

    My name is Debasish and I live in Santa Monica near UCLA. I think we all should get together and do something to mobilize our chapter here in So-Cal area. We all know that there are a lot of people who are on H1B and have applied for their GC. But they are waiting....

    For myself, I have applied for my GC and still waiting for the I-140. Don't know what they are doing in the TSC???

    So the idea should be to get them invloved...Somebody has rightly put it that we do not have a collective voice and that's why we are ignored...

    Hope you guys understand...

    I think we should start collecting database of people who have applied for their GC and waiting.

    If you have any input on this, I will gladly hear it...

    Hi,

    I sent PM to 200 active senior members of forum requesting sending emails & mails.

    Criteria used:
    1. Has to have atleast one post after 1st Sep 2008.
    2. Has to have atleast 200 posts.

    I got very positive response from members saying either they already sent mails or planning to send very soon or over the weekend.

    I haven't received 45 day letter yet. My lawyer faxed twice to find out the status but no reply from PBEC. Is there any way to find out the status?Anybody here whose case is pending from 2001.

    Typically they send replies after a month or so. So please be patient and give a month or two. Then you should see some info regarding case status.

    What is your opinion?

    My opinion is that USCIS does not deserve flowers or calculators. I am in a big favour of sending letters to them and to congress men with some information about what USCIS has been doing. I am also in favour of sending some pamphlets. I have already prepared some. Please see.

    My application was cleared before the BEC were started.

    My PD is March-2003 and I didn't get the labor cleared till Late 2006

    I just can't help wondering how did you get your labor in 2004 with the PD of May-2003? How come snake of BEC didn't bite you? :)

    Yesterday I filled up the appointment form of my local congressman. I will try if I can meet him and he could probably write to the public officials or could talk to rep. Zo Lofgren. In my opinion if we can somehow inform Rep. Lofgren, she will certainly do something. She seems really(genuinely) concerned for the plight of Green Card seekers...
    I would request everybody to find out ways and channels to get this information to her....

    i support your efforts and have printed out and sent letters to the people mentioned. Momentum for release of information should build up even if we have 50-100 letters from affected people...otherwise people won't know of EB-3 IND's plight.


    I suppose we should followup with phone calls in 15 days to cement our request. We should have a poll on who all has sent the letter and made the call.

    The numbers are assumptions and NOT facts. Most of these numbers have actually been pulled from other places or based on some rationale (for example 750,000 from Matthew Oh site, 5 minutes/EAD based on what need to be done to print out a card and pack in an envelop)
    Workforce of 30 though is a gross assumption. Bigger the number better it is. So we may actually want to question USCIS if there are any resource constraints.

    Outsourcing is a perfect Idea! What do you have in mind Wipro at Banglore? :D
    What about receipt notices? Isn't that teh first step? I do not believe it will take 20 months to get a receipt notice. Are you sure they have only 30 folks for EAD. Is that a known fact? What if it is 300?

    How about outsourcing it?

    My EB3 PD is Oct 2003. I-140 approved and I-485 ND is July24th.when can i expect to get the green card?. thanks in advance.

    I think all our folks here and myself have the same question too. My PD is 10/2003 and RD July 2nd. p_kumar, I can assure nobody can answer this question, not even USCIS. I am sure this site would have not existed if there was an answer. Sorry for beating round the bush, I am sure you would have known the answer by now.

    First of all EAD is not a status. You need to provide them details on whether you are on H1B or AOS / Parolee (if used AP to travel or EAD to work).

    I think I have been very lucky so far. I don't think USCIS processes based on anything concrete, I think it's a little random. Or maybe I am just lucky.

    I applied for PERM in Sep 2006 - EB3 - India.
    I got approved for PERM in Mar 2007.

    I applied for I-140 and I-485 concurrently in Jun 2007.
    I-140 got approved July 20, 2007 and on July 23, 2007 I received all 4 receipts for I-140, I-485, EAD and AP. So my approval came before my receipt. I live in California so everything went to Nebraksa.

    Lawyers emailed saying they also received the EAD card yesterday July 23, 2007.

    Now I have to wait for only AP and Adjustment. And I still have 5 years left on my H1-B (2 years on this visa and then another extension).

    So I say, anything is possible. I wake up every morning and pray to USCIS because they made my life better :) :) :)

    how did you applied in i-485 on June 2007? or you applied on July 2nd?
