Hi,
I am from India.I am on H4(dependent visa),with a stamped expiry date of May 7,2010 on my H4 visa and I-94.I got a J1 offer for further studies in USA.Till I get my required documents for J1 visa,I am guessing it will be beyond this date.My husband has already applied for his visa extension.
1.Now,if I plan to get stamping of J1 in Mexico after the H4 expiry date but with necessary receipts and documents (for H4 related),will I face any problems?
2.Do I need to go to India(my home country) for sure for stamping?
3.Is it better to have status change in USA itself(will delay start of the course)?
Awaiting for feedbacks.

Friends,
I filed consular processing when USCIS stopped accepting I485 applications in July.
Since USCIS revised the filing date, I filed I485 on 18th July.
My case went to Indian consulate a month ago but I got the I485 receipts and FP notice from USCIS recently.
We are planning to stick with I485 now. Are there any Issues here?. Is this going to delay my GC process as my case went to consulate, abroad already. Please pass on your ideas and suggestions. Thank you.

Just came across GAO's( General Accountability Office) recommendations to make changes in H-1B program. Eventhough they talk mainly about Staffing Companies and increased employer accountability, there seems to be a mention regarding the H1B extensions beyond 6 years with simultaneous application to green card. Eventhough not stating in exact words, it seems to hint to the congress to seriously relook at H-1B extensions beyond 6years and also regarding cap exempt Visas and supposedly how easy it is to get them. Looks like with the economy being how it is, Congress might use this report to jump in and bring some unfavourable changes. Any thoughts on this...?

Good Morning Folks,
How about this ? Lets say your consulting firm is ready to file your I-485 upon lots of restriction such as two year agreement and to spend around 10 gran.
While the big firm who has filed the PERM and waiting for the approval. In this case, can we do both the cases to see which is better upon the current situation.
This will help few of our folks and your thoughts are always appreciated.

Hello,
I have already filed I-751 under removal from country results in extreme hardship,I am going through divorce process,I want to change cateogory in I-751 [marrige entered into good faith but terminated by divorce] ,so please anybody can tell me that when I will get me my divorce decree I have to refile new I-751 for cateogory change into------marriage entered into good faith but terminated by divorce.so plz help me i need to refile or just only amendment letter to uscis.if any body has gone through this process plz help me.

I have 3yrs degree(Microbiology) and one year postgraduation diploma in computer science and 9years of work experience, Can I apply on EB2, some peolple saying at I-140 stage it gets problemetic with your degree, my employer says you can eligible to apply on EB2, Iam in real dilama, can any one please help me... thanks
I tend to think that your I140 in EB2 will be a problem. Specially so if your filing center is Nebraska. They have a reputation to be very very strict. Ask your employer if he has previously approved cases for people with your background.

I guess USCIS is sending Receipt Notes according to priority dates meaning with 2006-7 priority dates will get receipts later.
My 485 reached on 2nd july...No Update yet.
Can I ask any one get RN with priority date later than 2006?

I have applied for EAD renewal on September 1 2010. I have received receipt notice and checks are cashed . There was soft LUD on my case two weeks back without any change in status . To day I got email with case status � Initial Review� with following messsage
We have placed this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on hold because there is a pending litigation that may affect the outcome. We will resume processing as soon as the litigation is resolved. We will notify you by mail when we make a decision about your case, or if the office needs additional information.
This is my 5th my EAD Renewal and earlier I do not have any issues with Renewals . My current EAD Expires in December 1 Week . Please advise what I need to in this case , as I do not have any clue about pending litigation. Can I check with Local office about what was the pending litigation or do I need to approach through lawyer

I am on h1-b since Oct 1, 2004. I am EB3-ROW (Rest of World). My company has filed I-140 in June 2006 and it has not been approved yet. How soon would I be able to change jobs? I'm about to finish my master's degree and am hoping to get a job that falls in either eb-2 or eb3 category. How will this impact the ability to keep my i-140. Would i have to start from scratch with my new employer if i find a new job?
Also what is considered my priority date since I havent/cant file an i-485 yet.

- recently obtained a duplicate passport for my stolen passport, unfortunately also lost I-94 when received in Dec.08.
- Can I use the I-94 attached in the bottom of the I797? I won't have time to submit I102 and wait for replacement I-94.
- I've a trip coming very soon to Germany, last year had obtained the H1b stamping at US consulate in Germany, will it be ok if I apply for restamping at the same consulate because of time factor I'm not able to Canada or Mexico or India.
Any help and advise will be much appreciated. thanks !

Hi All,
Can any one give me what is the usual time frame given to respond to an RFE for I 140. I have seen in various threads that it is usually 12 weeks.
On Feb 22nd, I got an RFE on my 140 and the letter reached attorney's office on Mar 6th. On the RFE letter, USCIS has asked to repsond by April 7th. That is hardly 6 weeks and 4 weeks from the data I recd the letter. Is this usual?
