Hello,

I was wondering how long it took for everyone's check to be cashed once their packages were received at the TX service center? I'm worried because from what I read before the check cashing was almost immediate, while getting a receipt actually took longer. My package was received and signed for by Michael Salcedo on November 13th, but the check still hasn't cashed and I do not have a receipt. My husband and I are planning on travelling to Canada for Christmas, will crossing the border be a problem? Any advice anyone can give would be great! Thanks in advance!

I have a last pay check through an Employer A of August 1, 2008. Earlier before leaving Employer A I filed a H1 transfer to a new employer B and that got approved by USCIS but I didn't start working with Employer B. Now I am getting a new offer from Employer C which is better than Employer B. Attorney of Employer C says that he can file for a transfer through company A as the pay check is less than two weeks.

Now my problem is I not sure whether my transfer from A to C would be successfull or not?


Another thing I have not informed Employer B that I will not be joining him, Do I have to pay him all the H1 transfer fees?

Employment based I485 is pending and priority date is not current, and wont be current until we have cars that fly. Have valid advance parole from EB I485. Plan to file a family based I485 next month and wait for receipt notice and then travel out of country.

Is it possible to return to US on the advance parole from EB I485 after filing FB I485? (Application for a second advance parole based on for the FB I485 will be pending as it takes ~3 months to process AP).

I had a robbery case in the U.S. in 1995 and was sentenced to 9 years with 85%. Later, I was picked up by immigration and deported for the case in question. While I was in immigration jail I fought my case and won it but immigration appealed it on the first court. I decided to return voluntarily to my country instead of fighting my case over. Now I want to return home in the U.S.. I want to know how do I go about reopening my case.

My H1 with Employer A expires Dec 2009 (7th yr). By that time, if my I140 gets approved (with Employer A) I will be eligible for 3 year extensions from there on. Employer A is willing to keep the I-140 current even if I leave them. Now my question is,

* If I change to Employer B's H1 prior to I-140 approval with employer A, am I eligible to apply for 3 yr extension when I am with Employer B?

Can I transfer from Employer B back to Employer A (if my priority date for I-485 becomes current) when I am on the 3yr extension?


The reason I ask is, if my Priority date becomes current and apply for the I-485, I do not want to use my EAD card. I want to be on H1 to be on safe side (incase anything happens to I-485)

Will CIS Discontinue Intake of I- 485 Applications?

It is possible. Such an action would be illegal, but CIS has already stopped accepting I- 485 applications for another category known as "Other Workers," despite June Visa Bulletin showing that category is current. My advice to all of you is keep filing all through the month of July. For all we know, they may never issue such an illegal policy or they might lose a lawsuit filed against them. So keep filing.

Hi,

We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved?
Yes.

In case my I-140 is denied, will she lose her status and would have to leave the country?

I have got my EAD and want to do part time job as well as work on H1 for the employee who sponsored my GC, What is my status? I am still on H1 or AOS? I would be glad if someone can reply!

If you use your EAD (for part time or full time), you are on EAD and your H1B status is gone. It does not matter that you primary job is still on H1B.

Hello gurus..

I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?

All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

News letter to members is a good first step...I would suggest a news letter every week with just fund rising and also increasing memebership in mind .The wording should be tuned towards rising $$.You can put on big bold wordings at the top % met versus our target..

Keep rowing guys we are almost there!!


Also..somebody with good writing skills write 1/2 page letter..about 8 different formats and wordings...so we can print them out and gives us a list of senators address...each member can spend 37 cents...even better fedex these to senators asking for support on the Skil Bill...
