You can file I-485 only when your PD is current. There is no connection between filing for I-485 and I-140 approval.

Hi,
I applied for fresh EAD I-765 in Jan 2011....it is still in initial review stage.
M on L2 visa (dependant of L1)......and bcoz of some urgent reason ,here onwards i cant stay in US any more.
So,
1. Is there any provision for taking back application of I-765?(means i spent $380 for I-765,so can i get it return?)
Plz ....i need suggestion as early as possible!!

Hi gurus,
I need your help, I am due for my H1b first time extension and I have requested my employer for the 1500 dollars "Education and training fee" , I got an email from the New HR personal to show me why the employer have to pay for it , I am trying to find a link to USCIC website where it clearly states the employer has to pay for it.But I am unable to find any thing relating to $1500 education and training fee, I did google search and it shows links from some schools and law firms. I would rather send a UCSIC link to the HR personal. By the way i am filing my H1B via Visa Kit.

I was on H1 with my previous company but laid off last week. I have !485 AOS and EAD.
I believe I can straight away join any company (consultancy or any enterprise company) on EAD , right pls ?
if get a job offer from Comapny "A" and join them today and file AC-21 today and meanwhile say I get another job from another Company "B" after two days and join them, can I file another AC-21 without waiting to hear back from USCIS. I believe AC 21 is just informational for USCIS that I have switched the jobs.

If your 140 is approved the chances of 485 denial are quite remote. however most attorneys recommend that you try to stay on H1 as much as possible

I think we need to expose employers who are taking advantage of us in different ways just because we are stuck with them due to retrogression. This way if we cannot change the legislation right away we can atleast scare the crooks by exposing them so that they cannot trap new people.

Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

No. You can file two I-140 petitions from the same employer and your approved H-1B for three years is not in trouble. I don't blame you for your deepest concern in this issue, as USCIS made each and everyone of us so concerned about our every walk of our life.

Keep new approved H1 and all related documents with you for POE, also EVL.
I enered POE twice in similar situation as yours without new stamping.
Both times POE (Atlanta) experience was good for me.
I just entered even after new USCIS memo.
