New numbers are out on H-1B usage and the past week showed last week's substantial pickup was just noise. Only 800 visas were claimed against the 65,000 cap, half of last week's total and somewhat less than the typical weekly usage we've seen over the summer. 37,400 H-1Bs have been counted now. I'm moving my exhaustion projection date back a week. My target is based on a rolling four week usage average so variations from week to week are discounted. Since I am a canadian citizen, I do not require a visa for US and hence I don't have a H1B visa stamped on my passport.
Since you know this point, I am sure the American Visa Officer working in various consulates, too, would know this. If not, send a copy of the law that says "Canadian citizens do not need Visa to enter US".

I have a question. I heard about new premium processing rule for 140.
my friend�s six years is going to complete in next month , he has applied labour certification via PARM 10 months back and its pending, did he is eligible to file 140? Or he has to live next month?
Your friend cannot apply for I140 without approved labour. I don't know what other provision he has to be in status. May be he can try to recpture the vaccation time. If he has atleast 2 months of vaccation time, don't know if he can apply for 7th yr extension based on 365 days rule.

I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).

You could take a look at Track it. It will give you an idea of Atlanta backlogs . You could have a very good chance at Chicago though . Your friend was one in a million lucky and you could be one too .

My wife was working for a company before. They had filed for her GC. She has an approved I140. She had to convert to H4 because of some legal reasons and could not continue to work for the company. Now she has a valid H4.
She has already been here 7 years on her old H1. Now can she file for a H4-H1 and get a 3 year visa based on an approved 140 ?
The lawyer says that the 3 year extension rule just states that H can be continued beyond 6 years based on approved 140 and so she can go back to a H1...
Anyone here has had a similiar experience ?

I have applied for my I140 under EB2, I have a question regarding a gab between my employments. I worked for a company A from Dec 2005 to Feb 2007 and then I switched employers, and I was between projects. The next company I started working for gave me an offer letter only when I found a project (May 2007). So technically there is a 2 month gap. Even the experience letters from that company says I have started work from May 2007.
I'm not sure if this will cause a problem in my I140 stage. Kindly advice.

I am in EB3 with Labor and I-140 approved, I-485 in process, and have EAD/AP. If I switch employers and take up a new role (different from the one GC application is based on), and not file AC21 (because that's not applicable when switching job roles), should I continue to stay mum hoping to not receive a RFE for EVL and get a GC by mail silently someday or request new employer to file a new EB2 perm and preserve the old (2002) priority date?
In case I go with the former, and end up receiving a RFE, can I explain my true status and go for the latter at that point? What are the chances that one will receive an RFE for Employment verification for a case that has been pending for 7 years, and I-485 pending for 3 years?
Any personal experiences and guidance will greatly help me. Thank you!
