Hi,
I am a Indian. I got the L1 VISA on Mar-2008 and it is valid till Mar-2011. I have been to US with this VISA for 8 months during 2008. After returning from US, i have lost my I-129 and I-797 forms. I have the chance to goto US with same VISA but i donot have I-129 and I-797 forms.
Please let me know is it possible to get the papers back? I have enquired with my employer and they are saying that, it is very difficult to get the papers for the VISA which was issued 2 years back. Even, I donot have copies of I-129 and I-797.
Please advise me on this issue.

Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Or the end of that effort and the return to piecemeal legislating?...

My wife was on same boat as many students. Her H-1B petition had an rfe. RFE was later denied and we still have MTR. This year she got her H-1B approved without RFE. We did specify in application about previous year rejection.
Bottom line is there are no easy trends to observe. Luck seems to play a big role than anything else. Obviously, all the documents must be in good shape.

Hi,
H1 Company is based in Phoenix with another office in delaware.I have gievn my address from NewHampshire on my LCA and NJ on my I 140 application.I work for a client in Newyork.I have given my address in New hampshire as I was not sure that my project will be for a longterm and gave my cousins address in New Hampshire for LCA.
I got an RFE asking why I have different addresses on my LCA and I140 while my company is based out of Arizona and Delaware.Please suggest how I should be answering this.

You can travel using AP only. No need to worry about visa stamp! But take your lawyers advice on this too!

Click on Change of Address, on the left nav menu, Do this only if you have Receipt numbers, first it asks you to fill Electronic AR-11 for DOS then updates address on USCIS System.

Typically, visa backlogs are reduced by issuing visas and thus removing people from the demand list. In this case, the movement is due to decreased demand � people with approved petitions on the waiting list simply aren�t applying for visas.

The article says that dates have moved forward because the people whose dates are current, have not applied for their visas
And suppose we could do the same -- if no one applies the gc even once the PD is current, there will be forward movement.... then WHAM! In one go, all could apply
Anyway, just a thought (or you may call pipe dream :) )

The immigration system mirrors the economy, now we know it. H1B visas (http://www.h1b.biz/lawyer-attorney-1137085.html) are still available with more than 15,000 are up for grabs. The numbers are pretty much unchanged since late May.
As of August 14, 2009, approximately 45,000 H-1B cap-subject petitions and approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) have been received to reach the statutory limits, taking into account the fact that some of these petitions may be denied, revoked, or withdrawn. I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. Hi All,
I am applying my Labor on EB2 tomorrow (07/26/2007). Is there any glim chacne for me to get the approval before 08/14/2007? I am going through Atlanta. Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).
